These Terms and Conditions form the basis of the contract between Hire It Furniture Ltd and the Client. Payment of any fee or provision of a Purchase Order is considered acceptance of these terms.
1. Definitions
- “The Company”: Hire It Furniture Ltd, trading as Hire It.
- “The Client” / “The Customer”: Any company or organisation contracted with Hire It Furniture Ltd for the supply of goods and/or services.
- “The Goods”: Any items subject to any contract between the Company and the Client.
- “The Contract”: Any written or verbal agreement for the Company to provide Goods and/or Services.
- “Delivery”: The transfer of Goods to the Customer, either via the Company’s team or by Client collection.
2. Quotes, Booking & Payment
- Quotes: Written quotes are valid for a maximum of 7 days and may be withdrawn at any time before confirmation. Only written quotes will be honoured.
- Booking Confirmation: The availability of Goods cannot be guaranteed until an order is confirmed. An order is confirmed and stock is reserved upon payment of the required deposit.
- Payment: Payments can be made by bank transfer or by debit/credit card (fees may apply). Full payment is required in cleared funds before Delivery or self-collection, unless credit terms have been agreed upon.
- Credit Terms: The Company’s standard credit terms are 30 days from the date of the invoice, unless otherwise agreed in advance. Credit terms may be withdrawn at any time.
- Late Payments: The Client must pay by the due date specified in the agreement. The Company reserves the right to charge interest on overdue invoices at a rate of 2.5% above the Bank of England’s lending rate.
3. Deposit & Damage Waiver
- Standard Refundable Deposit: The Company requires a refundable deposit of 50% of the hire value as security against damages, loss, and other charges.
- Deposit with Purchase Order: For Clients providing an official Purchase Order, the 50% deposit requirement is waived. Instead, a 20% deposit of the order value is required to secure the order.
- Deposit Refund: The deposit will be refunded within 14-30 days after the Goods have been returned and inspected at the warehouse. The Company reserves the right to retain all or part of the deposit to cover any loss, damage, or additional charges. A damage report will be sent to the Client if any deductions are made.
- Slight Damage Waiver: A mandatory, non-refundable fee of 3% is charged on all bookings. This fee covers standard post-hire cleaning and general wear and tear. It does not cover missing or damaged furniture, for which the Client is liable for the full repair or replacement cost.
4. Cancellation & Postponement
- Cancellation Procedure: All cancellations must be made in writing (email or recorded post) and are only effective once the Client receives confirmation from the Company.
- Cancellation Charges:
- More than 14 days before delivery: 25% of the hire charge is payable.
- Within 14 days of the delivery date: 50% of the hire charge is payable.
- Within 7 days of the delivery date: 100% of the hire charge is payable.
- Postponement: Postponed orders will be issued a credit note for the value of the hire, valid for 12 months. The deposit will be refunded upon postponement.
- Contracted Booking Cancellation: For advance bookings with a minimum value of £20,000 per event, the following terms apply:
- Cancellation within 90 days of delivery: 55% of the order value is payable.
- Cancellation within 60 days of delivery: 100% of the order value is payable.
- The Company may exercise discretion on these charges on a case-by-case basis.
5. Delivery & Collection
- Parking: The Client is responsible for providing adequate, legal parking. Failure to do so may result in refused delivery, with no refund issued. Any parking fines incurred will be charged to the Client with a £25 admin fee.
- Kerbside Service: Standard delivery is a kerbside service to a ground floor/street level location with step-free access within 10 metres of the vehicle. Deliveries involving stairs, narrow corridors, or other obstructions may be subject to additional charges.
- Waiting Time: The first 30 minutes of waiting time on site is free. Thereafter, waiting time is charged at £20 + VAT per 15-minute increment. If access is refused or delayed, a charge of £80 per hour may apply.
- Preparation for Collection: Goods must be dismantled, stacked, and gathered in the location they were delivered to. Additional labour charges may apply if Goods are not ready.
- Client Presence: The Client or a representative must be present for delivery and collection. If no one is present, the Client automatically accepts the Company’s assessment of the Goods’ condition and quantity.
6. Hire It Crew Bookings & Hospitality
- Service Tiers: Crewed services include “Premium Service” (3 hours of crew service allocated for full installation) and “Standard Plus Service” (2 hours allocated for delivery to a specific location). Additional time is charged at an hourly rate.
- Crew Waiting Time: If the event space is not available at the agreed-upon time, a waiting charge of £90 per hour will be levied.
- Hospitality: For crew on-site:
- Over 4 hours: Light refreshments must be provided.
- Longer durations: A hot meal or a £25 meal allowance is required.
- Over 8 hours: Both lunch and a hot evening meal or a £45 subsistence allowance must be provided.
- Accommodation: For events over 60 miles from London finishing after midnight, the Client must provide B&B accommodation, by prior agreement.
7. Self-Collection & Return
- Payment Terms: Credit terms do not apply to self-collection orders. A 50% refundable deposit and full payment are required before any Goods can be released.
- ID Requirement: A valid photo ID (Passport, Driver’s License) must be provided.
- Vehicle Suitability: The Client must use a suitable vehicle with means to secure the Goods safely. The Company reserves the right to refuse release to an unsuitable vehicle.
- Condition Acceptance: The Client is responsible for accepting the condition of the Goods upon collection.
8. Damage, Loss & Liability
- Client Responsibility: The Client is solely responsible for the Goods throughout the Hire Period. Goods must be stored in secure, dry conditions and returned clean and dry.
- Damage Charges:
- Repairable Damage: Charged at £30 per hour, per item.
- Irreparable Damage/Loss: Charged at the full retail value.
- Upholstery Cleaning: A minimum charge of £45.
- Limitation of Liability: The Company’s total liability is limited to the price the customer has agreed to pay for the hire contract. The Company is not responsible for any additional costs or loss of earnings incurred by the Client.
- Force Majeure: The Company is not liable for failure to perform due to events beyond its reasonable control, such as accidents, fire, floods, or legislation.
- Governing Law: This contract is governed by the laws of England and Wales.
